Sir/Madam,

With reference to your complaint/intimation dated 08/02/2023, I am directed to inform you that the above mentioned complaint/intimation along with the report received from the concerned authorities were placed before the Commission on 17/07/2023 Upon persuing the same, the Commission has directed as follows :-

The complainant, in the instant case, based one media reports has alleged that one Priyanshu Kumar (aged about 12 years) died   due to electrocution on 07.02.2023. The fatal incident is stated to have occurred in an area under District-Hazaribagh, Jharkhand. The complainant has alleged negligence on part of the Power Corporation, thus, is seeking Commission's intervention for payment of compensation to the family of the victim and other necessary action. The Commission vide its proceedings dated 01.05.2023 had directed the Secretary, Dept. of Power, Govt. of Jharkhand; District Magistrate, Hazaribagh, Jharkhand and the Sr. Superintendent of Police, Hazaribagh, Jharkhand for submission of requisite action taken report in the instant case. The copy of the direction was also communicated to the Chief Secretary, Govt. of Jharkhand for information and necessary action. Pursuant to the directions of the Commission, report dated 05.05.2023 of the Deputy General Manager, Jharkhand Vidhyut Vitran Nigam Ltd., Ranchi has been submitted wherein it is stated that monetary compensation of Rs. 5 Lakhs has been paid to the mother  of the deceased on 18.04.2023 through cheque. The Registry is directed to transmit copy of the report dated 05.05.2023 of the Deputy General Manager, Jharkhand Vidhyut Vitran Nigam Ltd., to the complainant, calling for the comment, if any within four weeks, positively. In case, the response from the complainant is not received within the stipulated time, the Commission shall proceed further on the basis of documents available on record.

2.     Pursuant to the above directions, I am enclosing herewith a copy of the report for furnishing your comments, if any, by 24/08/2023, for consideration of the Commission.

The Commission took cognizance of a complaint dated 01.06.2020 receivdd  from Sh. Onkar Vishwakarma, HRD alleging that due to lack of anaesthesia facility in the hospital, the victim was denied maternity care due to which her child died in the womb. Commission on consideration of report vide its order dated 16.08.2022, directed the Govt. of Jharkhand through its Chief Secretary to pay a monetary compensation of Rupees Two Lakhs to the victim Smt. Kalidasi Marandi and submit the compliance report along with proof of payment. Pursuant to the directions of the Commission, Under Secretary to Govt., Home, Jail and Disaster Department, Jharkhand vide letter dated 28.02.2023  has submitted that monetary compensation of Rs 2,00,000/- has been paid to victim vide bank draft No. 417819 dated 23.12.2022. Proof of payment has been enclosed. Since direction of the Commission has been accepted by the Govt. of Jharkhand and proof of payment has been submitted, the case is closed.

The Commission on 09.7.2022 has received a complaint from Shri Onkar Vishwakarma, a human rights activist from, Varanasi, Uttar Pradesh referring to a news report run by Public App revealing that one worker of the Electricity company has died due to electrocution as he came in contact with electricity cable in Koderma district of Jharkhand. The complainant has requested the Commission to intervene into the matter. Pursuant to the direction of the Commission, report of Under Secretary to the Govt.of Jharkhand, Energy Department dated 26.5.2023 has been submitted stating that agency M/S Nidan Enterprises paid the widow of the deceased namely Anita Kumari monetary compensation of Rs. 3.00 lakhs along with arrear pension of Rs.21,985/- and at the same time Rs.4,40,682/- has been deposited in the bank account of the NoK by way of PF Insurance on 26.12.2022. In view of the above report since the NoK of the deceased has been duly compensated and the grievance of the victim has been meted out, further intervention of the Commission is not called for. The report is taken on record and the case is closed.

नवलशाही थाना प्रभारी अनिल सिंह ने खुले मैदान में मेरी पत्नी, माँ के सामने मार कर बेहोश किया|

मै सकलदेव स्वर्णकार उम्र 28 वर्ष पिता स्व बंशी स्वर्णकार ग्राम बीघा पोस्ट फुलवरिया थाना नवलशाही जिला कोडरमा राज्य झारखण्ड का मूल निवासी हु

मै कक्षा सात तक की पढाई किया हु और मै जेवर बनाने का कारीगरी करता हु मै गरीब परिवार से हूँ मेरे पिता जी बचपन में ही स्वर्गवासहो गए हमें पिता का प्यार नहीं मिला, जो कुछ है मेरी माँ ही सब कुछ है|             

मेरी घटना यह है कि 17 अप्रैल 2023 को सुबह मेरी माँ के साथ गाँव के पडोसी पूजा देवी इत्यादि मार पिट कर दिए जब मै इस घटना की छान बीन करने लगा तब पता चला तो मेरा भतीजा टिकू स्वर्णकार और पूजा देवी के बिच गाली गलौज हुआ| जो आपसी घर का मामला था इस मामले में पूजा देवी पति किशन स्वर्णकार निवासी बीघा नवलशाही थाना में जा कर आवेदन दी जिसके बाद नवलशाही पुलिस 17 अप्रैल 2023 को दिन के 2 बजे चार पुलिस वाले गाडी से मेरे घर पर आये, और हमें और टिंकू स्वर्णकार को उठा कर ले गई| हमें ले जाते समय किसी से कोई हस्ताक्षर नहीं करवाया, मै पुलिस को बोलता रहा की मेरा कोई दोष नहीं है आप हमें क्यों ले जा रहे है? थाना ला कर हमें बैठा दिए, कुछ देर बाद पूजा देवी थाना आई वह थाना में बताई की सकलदेव का कोई दोष नहीं है, इसे क्यों ले आये? हमने आवेदन में इसका नाम भी नहीं दिए है| थाना में दोनों पक्ष टिंकू स्वर्णकार और पूजा देवी के बिच आपसी समझौता हो गया, चुकी दोनों पड़ोस के थे| समझौता होने के बाद शाम को 5 बजे हम थाना से निकल रहे थे तभी थाना प्रभारी अपने केबिन से निकल कर आये और हाँथ से मेरे मुंह पर आठ दस थप्पड़ मार दिया, मारने के साथ साथ गन्दा गन्दा गाली देते रहे वही मेरी माँ, मेरा भाई, मेरी पत्नी, मेरे जीजा मेरी भाभी, सभी सामने खड़े यह सब देख रहे थे, इतना मारने के बाद थाना प्रभारी अनिल सिंह प्लास्टिक रूल का डंडा मंगवाया और डंडा से बेरहमी से खुले मैदान में ही पचास से अधिक लाठी मारा, भयानक गर्मी और लाठियों के मार से मै रोता चिल्लाता बेहोश हो गया, यह सब देख कर मेरी माँ रोने लगी मेरी पत्नी रोने चिल्लाने लगी, सबके आँख लाल हो गए, परन्तु थाना प्रभारी के सामने कोई नहीं आया और वह हमें बेहोश होने पर भी भूखे जानवर की तरह मरता रहा, जब वह थक गया तब हमें छोड़ दिया, जिसके बाद मेरी माँ दौड़ कर हमें अपने गोद में उठाई, और मेरी पत्नी होंश में लाने के लिए मेरा पैर रगड़ने लगी, तभी थाना के चौकीदार ने पानी ला कर मेरे मुंह पर डाला जिसके बाद हमें होंस आया , मेरा पूरा बदन लाल हो गया था जहाँ भी लाठी पड़ा लाल बम्बू उखड गया था, मुझे बहुत जोर से गुस्सा आ रहा था परन्तु मै चाह कर कुछ भी नहीं कर सका| मुझे लग रहा था मेरा कोई गलती नहीं और पुलिस हमें क्यों मारी मुझे लग रहा था की मै आत्महत्या कर लू परन्तु माँ पत्नी का चेहरा सामने आ गया उसे देख कर जीने को जी चाहा| मेरे घर वाले वहा से उठा कर हमें तुरंत डोमचांच रेफरल हॉस्पिटल ले आये, जहा पर मेरा इलाज हुआ, रेफरल अस्पताल ने मेरी गंभीर स्थिति को देखते हुए सदर अस्पताल कोडरमा भेज दिया, जहा पर मेरा इलाज चला जिसके बाद हमें दुसरे दिन छुट्टी दे दिया|

इस घटना के बाद पुलिस अधीक्षक कोडरमा को हमने आवेदन दे कर बताया की नवलशाही थाना की पुलिस ने हमारे साथ यह सब किया है| परन्तु पुलिस ने इस मामले पर कोई क़ानूनी कार्यवाही नहीं किया है| वही इस पुरे घटना से पुलिस उपमहानिरीक्षक हजारीबाग को भी अवगत कराया वहा से भी कोई कार्यवाही नहीं हुआ है|

मै चाहता हु की इस दरिन्दे पुलिस वाले पर क़ानूनी कार्यवाही हो और हमें इन्साफ मिले इसे किसी के बेटे का दर्द और किसी के पति का दर्द समझ में नहीं आता है ये पुलिस है या जानवर हमें कुछ समझ नहीं आया है|

हमें बस इन्साफ चाहिए और जिस पुलिस वाले ने हमारे साथ गलत किया है उस पर क़ानूनी कार्यवाही|

मै मनोज कुमार उम्र 45 वर्ष पिता मेघलाल साव ग्राम भीमेडीह पोस्ट नवलशाही थाना नवलशाही जिला कोडरमा झारखण्ड का मूल निवासी हूँ | मेरे परिवार में मेरी पत्नी के साथ दो बच्चे और मेरे माता-पिता रहते है | हम ड्राइवर है, गाडी चलने का काम करते है |

 

मेरा घर परिवार खुशाल था हम चन्द रुपया ही कमाते थे जिससे घर परिवार का जीविका चल सके और अच्छे से रह रहे थे मेरे बच्चे गाँव के ही सरकारी स्कुल में पढाई करते है |

 

मेरे साथ अचानक से एक हादसा हो गया जिसका हमें तनिक भी एहसास नहीं था, की हमारे साथ ऐसा भी कुछ होगा ? मेरे घर के बगल में रहने वाले बालो साव और टेकलाल साव जो दोनों मेरे पडोसी है इन दोनों के साथ मेरा अच्छा रिश्ता था हमलोग एक थाली में खाने वाले थे परन्तु इस परिवार के साथ मेरा विवाद तब बढ़ गया जब वह घर बनाने लगा तो वह जबरन मेरे जमीन पर घर बना रहा था हम उसे मना किये बोले आप अमीन ला कर नापी करवा लीजिये जिसको ले कर हम 28 मई 2021 को नवलशाही थाना में आवेद दिए थे, और थाना वाला आ कर मना कर के गया था, परन्तु वो दोनों भाई जबरन बनाने लगे जिसे ले कर 29 मई 2021 के शाम को मेरे पिता जी उनलोगों को काम करने के लिए मना किये परन्तु वो लोग नहीं माने और गाली गलौज पर उतर आये और ईटा पत्थर चलाने लगे जिसके बाद हमलोग 29 के शाम को थाना जा कर इसकी सुचना दिए और पूरा धटना बताये, थाना वाले बोले सुबह में आ कर रुकवा देंगे | उसके बाद मेरे पिता जी साथ ही आये अन्य लोग थाना से घर चले आये 30 मई सुबह को हम घर आये जिसके बाद हम 30 मई 2021 को ही उसको पूछने गए की आप मेरे घर में गाली गलौज क्यों किया ? आपने अमीन ला कर नापी करवाने की बात की थी तो आपने क्यों नहीं किया? इतना पूछ ताछ करते ही थे की तभी महेंद्र साव टांगी से मेरे सर पर वार कर दिया हम तुरंत वही गिर गए तभी मेरी पत्नी यह देख कर चिल्लाते हुए वहा गई तो मेरी पत्नी को डालो साव रॉड से मार दिया वह भी घायल हो गर जमीन पर गिर गई, जिसके बाद मेरे पिता जी देख कर चिल्ला कर दौड़े तो उसे भी नारायण साव मार कर घायल कर दिया, मेरी बहन को भी उनलोगों ने टांगी से मार कर घायल कर दिया, जिसके बाद मेरे भांजे को मार कर उसके दाहिने हाथ का ऊँगली तोड़ दिया जिसके बाद हमें होश आया मेरे भगिना हमें और मेरी पत्नी को उठा मोटरसाइकिल से ले कर थाना ले कर आया वहा पुलिस हमें देखते ही बोला की आपको हॉस्पिटल जाना चाहिए था यहाँ क्यों आ गया, हम बोले सर जिस समय ईटा पत्थर चल रहा था उस समय हम आपको बताये तो आप नहीं आये अब ये हाल हो गया मेरा घर वाला भी आपके दरवाजे पर आया परन्तु आप नहीं सुने, हर पल का रिपोर्ट आपको दे रहे थे परन्तु आपने कोई एक्शन नहीं लिया, जिसके बाद पुलिस अपने गाडी से ले कर हमें और मेरी पत्नी को रेफरल अस्पताल डोमचांच लाया जहा पर प्राथमिक उपचार में मेरे सर पर 11 टाका लगा मेरी पत्नी को 22 टाके लगे जिसके बाद हमें और मेरी पत्नी को सदर कोडरमा भेज दिया गया, मेरे पिता जी और माँ वही पड़े रहे, उन्हें वहा से एम्बुलेंस से कोडरमा सदर ले जाया गया, वहा हमें भर्ती नहीं लिया, जिसके बाद हम पूरा परिवार पुलिस अधीक्षक के पास गए वहा पर बताये तब इंस्पेक्टर को फोन किया गया फिर हमें सदर भेज दिया गया जहा पर, पिता जी को 8 टाका लगा इस तरह हम घर वाले पूरी तरह बर्बाद हो गए थे, पुलिस हमें इंजोरी काट कर नहीं दिया था, उसी दिन शाम को इंस्पेक्टर साहब हमें और मेरे पुरे परिवार को सदर में बोले की आपलोग डोमचांच थाना आइये, हमलोग आने के हालत में नहीं थे फिर भी हिम्मत कर के डोमचांच थाना आये जहा पर नवलशाही थाना के बड़ा बाबु और विजय सिंह पुलिस भी था वहा पर हमसे पूछ ताछ किया गया, हम पूरा घटना बताये पुलिस बोला की आपके साथ बड़ा गलत हुआ जिसके बाद पुलिस हमसे आवेदन लिख कर माँगा, हम बोले सर हम अभी लिखने नहीं जानते है आप हमें वक्त दीजिए हम लिख कर देंगे, परन्तु इंस्पेक्टर मेरे ऊपर जबरन दबाव बना कर हमसे थाना में आवेदन लिखवाया, हम फिर भी बोले सर किसी मुंसी से लिखवा दीजिए हम तो सारा चीज बता रहे है परन्तु पुलिस इसके लिए तैयार नहीं हुआ, जिसके बाद एक रफ पेपर पर मुंसी चार लाइन लिख कर दिया जिसे देख कर मेरा भाई बिरेन्द्र साव उतार कर दे दिया, वह भी बोला की हम नहीं लिख पाएंगे परन्तु उसे भी जबरन पुलिस अपने सामने ही बैठ कर उसी तरह लिखवाया जिस तरह वह लिख कर दिया था, मेरा भाई लिख कर दे दिया, उस समाया हमें लग रहा था की हमें कब इंसाफ मिलेगा ? हम तो उसे बस पूछने गए थे परन्तु वह मेरे ऊपर हमला कर दिया, हमें लग रहा था की घर का पडोसी ऐसा कैसे कर सकता है हम यही सब सोच कर परेशान हो रहे थे, सदर अस्पताल में 8 दिनों तक भर्ती रहे उस समाय मेरे ससुराल के लोग हमें मदद कर रहे थे, इलाज के बाद हमें और मेरे परिवार वालो को छुटी मिला, जिसके बाद हम थाना गया तो थाना में हमसे गवाह माँगा गया हम गवाह दिए फिर भी पुलिस ने कोई कार्यवाही नहीं की बाद में हमें पता चला की मेरे ऊपर भी चोरी का केस दर्ज हो गया है, और उन लोगो में किसी की गिरफ़्तारी भी नहीं हुई हम पुलिस को पूछे की सर उन लोगो का गिरफ़्तारी क्यों नहीं हुआ तो पुलिस बोला की तुम गिरफ्तारी में क्यों पड़े हो पहले अपना बेल करवाओ उसके बाद कार्यवाही होगीI जिसके बाद हम थाना से निराश हो कर घर चले आये, मेर पत्नी आज भी चल फिर नहीं पा रही है, घर में कोई काम नहीं हो रहा है, घर का खाना भी दुसरे घर से हमें मिल रहा है, और मेरे खिलाफ पुरे गाँव में यह प्रचार किया जा रहा है की उसको बोलो जमीन छोड़ देगा नहीं तो एक बार माथा फाड़ कर मारे है अबर तो खत्म ही कर देंगे, देखेंगे कौन क्या करेगा? इतना मारे तो अन्दर नहीं गए अब कैसे जायेंगे मेरा कुछ नहीं होगा ?अब हमें समझ में नहीं आ रहा की कहा इंसाफ मांगे और कहा फरियाद करे इस घटना की जानकारी कोडरमा पुलिस अधीक्षक मुख्यमंत्री और अन्य आला अधिकारियो को भी दिए परन्तु कही से कुछ नहीं हुआ है हम और मेरा पूरा परिवार डरे हुए है हमें लग रहा है की हम गाँव छोड़ दे क्योकि पुलिस भी मेरा नहीं सुनता है |

 हम चाहते है की मेरे मामले में न्यायिक कार्यवाही हो और पुलिस दोषियों पर कार्यवाही करे!

There is no need to application in case of murder, we will do everything by the police

My name is Jagdish Yadav age - 58 years, father Late Hardayal Yadav Village - Buchai, Post - Kapka, Thana - Barkattha, District - Hazaribagh I am a native of Jharkhand, I am doing farming to support my family and children.

 

Two years ago my son Santosh had bought a car for two lakh sixty thousand rupees from Prakash Yadav son Shri Etwari Yadav Nivasi Village Ghorbandha Panchayat Salaidih Police Station- Chalakusa District Hazaribagh Boloro, in exchange for which he had given fifty thousand rupees and to pay the rest of the money later. Resignation was done but after three days my son returned the car because he did not like the car.

 

My son gave the car back to him after three days and said we do not like the car, Prakash returned thirty thousand rupees immediately and asked to give twenty thousand rupees later, my son kept asking for money again and again but Prakash Yadav returned not given

 

On 5th April 2020 at 6 o'clock in the evening, my son went to Prakash Yadav's house to ask for money on his motorcycle, where both of them were heard, after which Prakash Yadav killed my son a lot by tying him with a rope to an electric pole. There was a lot of crowd due to the scream of the son.

 

After a while, in front of the village headman and other dignitaries, agreeing that on April 15, 2020, the panchayat will be done, you will get the money. After listening to those people, my son came back.

 

On 12 April 2020, on Santosh's mobile number 9262789788] 6205184557, at around 9 to 10 in the morning, Balo Singh Age - about 30 years, Father - Karu Singh alias Ramesh Singh, and Saryu Singh (Parachner) Age - about 35 years Father Jorbali Singh Village Khaira Panchayat Tuiyo Thana Barkatha called today for cock party. After hanging up the phone, Santosh went away.

 

 

We searched a lot till evening but could not find any satisfaction anywhere. His mobile was also turning off. We found out by calling his friend Umesh Yadav, father Bhuneshwar Yadav, village Chandgarh Panchayat, Bedokla police station, Barkatha district, Hazaribagh, and came to know that after taking 4 bottles of liquor from him, he went to Balo Singh's place. After which we went to ask Balo Singh also, he accepted that yes he had come to my place. There is no information after that. We also called the police station and gave information, but the police station also told that there is no information about Santosh.

 

On April 13, 2020, at 10 o'clock, Khaira village resident Saryu Singh informed the village chief Dashrath Yadav that Santosh's body was lying in the forest. As soon as he got the news, he came running. Santosh's body was taken into custody by the police and his car was also recovered.

 

When the police brought the dead body home after conducting a post-mortem. Police are interrogating us only after the delivery. A mountain of trouble had fallen on me at this time. Were tired of searching the son since yesterday morning. We all had lost our senses by crying. When the police saw that we were not able to tell anything, then she left.

 

After performing the last rites of the son, we went to the police station after taking the application on the second day. The police present there refused to take the application for the FIR, saying that there is no need for the application. We will do everything My soul is torn by this behavior of the police. My heart is saying that the police has bowed down in front of that mafia Prakash Yadav. He is being called Ji Hujuri. What happened after that, we do not know anything, now I have nothing left except to cry for the rest of my life.

 

I want that justice should be given to us by taking legal action against the guilty police personnel in this case.

I was under mental stress for a week due to the beating of the police.

 

My name is Pawan Kumar, age 30 years, (Divyang) father Late Harilal Modi, I am a resident of village Khuta, Post-Khuta, Thana- Satgaon, District- Koderma, Jharkhand. I am physically handicapped and unable to move. If I have to go anywhere in my house, then my family members and nearby people take us to take them. If we have to go far, we go by tricycle.
 
My incident is that a boy had a road accident in the neighborhood of my house as we heard that Raja Kumar who had a road accident could have been saved. But due to the negligence of the doctors here, he lost his life. Many people in my village were very angry about this. Medicine in every fifth house of my village house. He had only one son who was very promising and used to listen and do everything in the village house. But that too is no more. The whole village was immersed in grief due to this incident. Then a few people of the village sat on the road on 18th June for the Gharna demonstration. About 50 to 60 people were sitting on the road making social distance. All this was happening in front of my house and I was watching. We felt that people are going to make some changes today. There will be some effect of their household.
 
After some time, this protest demonstration slowly started taking the form of a crowd, the police was also present here and people were shouting slogans, it was only a matter of time that a large number of people gathered and the round of slogans became very fast. Slogans were being given that "Remove Chandramohan, save Satgaon", stop Geeta clinic, stop looting in the name of health etc. Slogans were going on. I had work in Satgaon market so I went to Basodih on my tricycle before that crowd. People were coming back and forth. I thought these people would make some changes today, the anger of the people was strong and the slogan was also loud. At that time I was doing my work in Satgaon market, the crowd was moving forward. I was watching from afar Then we came to know that some people are pelting stones on the hospital. Then I felt that something wrong would happen. I started watching for some time, then suddenly the police reached to us. After which we could tell something to the policeman that the police started pelting sticks on me too.
 
Didn't even tell us anything and beat me to inflate my body. I kept begging them a lot that I am Divyank. Why are they killing us but they did not listen to me and we were beaten up. I was tormented by pain. I had injuries in parts of my body that were more complex and break places. I was not able to bear the pain now, so immediately went to the doctor and got myself treated there, after the treatment, I came to my home. In the house, I kept crying with pain, we felt again and again that why the police killed us, we had not done any mistake then why did the CRPF jawan kill us. We were feeling guilty from inside. We were very upset. I was under mental stress for a week, people used to respect me a lot. I am fed up with so many thoughts of how I will go in front of him.
 
I feel very at peace to tell you all this. We feel that we will get justice now. All we say is that the police who have beaten us should take judicial action on that matter and we should get justice.
